      COOPERATING BROKER / PROCURING CAUSE POLICY

The National Association Of Realtors defines "Procuring Cause" as the “interplay of factors which together demonstrate that the unbroken efforts of a specific broker were responsible for the buyer making the decision to consummate the deal on terms which the seller found acceptable. In other words, the sale would not have occurred but for the broker’s efforts.” (www.realtor.org.)


Many factors can affect the procuring cause issue. For this reason, Prudential Commercial Services Iwado Realty has developed policies to protect your position as cooperating broker and procuring cause. These policies include:

1)  We ask all potential buyers and tenants to sign a disclosure form in which they declare:

     a) If they are working with a broker.
     b) Who the broker is and any special relationship they may have. 
     c) What our agency relationship is to the buyer or tenant.

2) If they list you as their broker, we will contact you to be involved in the transaction at that time.

3)  We expect you to instruct your buyers / tenants that you should be the initial person to contact our office regarding a specific property.

4)  We expect you to accompany your buyer or tenant on the first showing or meeting; and if this is not possible, that you will contact us prior to the showing.

5)  We expect that you will be a part of any negotiations and that all offers or contracts are submitted through you.

As professionals, we encourage all buyers and tenants to be represented during any real estate transaction. We want you to get paid for your hard work. However ...

If you are not the procuring cause,
then you will need to ask your clients to pay your compensation.
